1. Definitions
"Company" refers to Black Cat Services Group Limited.
"Customer" refers to the individual or organisation requesting services.
"Services" refer to the work performed by the Company, including but not limited to garden clearance, site clearance, waste removal, haulage, pressure washing, and light demolition.
"Agreement" refers to the contractual agreement formed upon acceptance of a quotation or commencement of services.
2. Scope of Services
2.1 The Company will provide the Services as agreed upon in the quotation or confirmed in writing, phone, or digital communications.
2.2 Any additional work requested by the Customer not included in the original agreement may incur additional charges.
3. Quotations and Pricing
3.1 All quotations are valid for 14 days unless otherwise stated.
3.2 Prices are based on the information provided by the Customer and may vary if the scope of work changes or if additional services are required.
4. Booking and Cancellation
4.1 Bookings are confirmed upon written acceptance by the Customer or via verbal agreement followed by a confirmation message.
4.2 Cancellations made less than 24 hours before the scheduled start time may incur a cancellation fee of up to 25% of the quoted price.
4.3 The Company reserves the right to cancel or reschedule services due to adverse weather, safety concerns, vehicle or equipment failure, or other unforeseen circumstances.
5. Payment Terms
5.1 Payment is due upon completion of the work and receipt of an invoice, unless otherwise agreed in writing.
5.2 Invoices not paid within 14 days may incur a late payment fee of 5%.
5.3 The Company reserves the right to withhold or suspend services in cases of non-payment.
6. Waste Removal and Disposal
6.1 The Company is registered to carry non-hazardous waste. Hazardous waste (e.g. asbestos, chemicals, medical waste) will not be accepted under standard services.
6.2 The Company may, at its discretion, make provisions for the lawful disposal of hazardous waste upon request. Such services will incur additional fees and must be agreed upon in writing prior to commencement.
6.3 Waste is disposed of at licensed facilities in accordance with local environmental and safety regulations.
6.4 The Customer is responsible for confirming that all waste to be collected is suitable for removal.
7. Access and Site Conditions
7.1 The Customer must ensure clear, safe access to the work area at the agreed time.
7.2 Delays or additional labour caused by restricted access or unprepared sites may incur extra charges.
7.3 The Company will take reasonable care to avoid damage, but is not liable for damage to driveways, pathways, lawns, underground services or surfaces where access has been granted for vehicles or heavy equipment.
8. Customer Responsibilities
8.1 The Customer must inform the Company of any hazards, restrictions, or special considerations before work begins.
8.2 Children and pets must be kept clear of work areas during service delivery.
8.3 The Customer must not instruct staff or subcontractors to carry out work outside the agreed scope.
9. Insurance and Liability
9.1 The Company holds public liability insurance appropriate to the nature of its work.
9.2 The Company is not liable for loss, damage, or delay caused by events beyond its reasonable control.
9.3 Liability for accidental damage is limited to the value of the Services provided.
10. Equipment and Machinery
10.1 All equipment used remains the property of the Company unless otherwise agreed.
10.2 The Customer shall not tamper with, operate, or allow others to operate Company-owned machinery or vehicles.
11. Health and Safety
11.1 The Company will carry out a risk assessment prior to commencing work. Proportional to the work involved, these may be done either in written or verbal form.
11.2 Staff and subcontractors will wear PPE appropriate to work activities and locations, and follow safety procedures.
11.3 The Company reserves the right to stop work if conditions are deemed unsafe.
12. Termination of Agreement
12.1 Either party may terminate the Agreement with written notice if the other party breaches a material term of these conditions.
12.2 Termination does not affect rights or liabilities accrued prior to termination.
13. Governing Law
These Terms and Conditions are governed by the laws of Guernsey, Channel Islands. Disputes shall be subject to the exclusive jurisdiction of the Guernsey courts.
14. Amendments
The Company reserves the right to amend these Terms and Conditions at any time. The most recent version will be made available upon request and published on the Company’s website.
